Agreement and order of documents

These terms govern use of the public website and services unless a signed order form, enterprise agreement, data processing agreement, or other written contract says otherwise. For a conflict, the signed document controls for its subject matter, followed by these terms, the Acceptable use policy, and product documentation. Virturing means the contracting entity identified in the applicable order, invoice, or account record.

Eligibility and accounts

You must have legal capacity to accept these terms and authority to act for the organization you register. Provide accurate information, keep account contacts current, protect credentials and recovery methods, restrict access to authorized users, and notify Virturing promptly of suspected compromise. You are responsible for activity performed through your account unless caused by Virturing's breach of its obligations.

Service scope and availability

Services may include websites, dashboards, APIs, SDKs, phone-number inventory, carrier routes, calls, media transport, AI agents, recordings, transcripts, campaigns, queues, and support. Availability depends on market, carrier, documentation, intended use, technical compatibility, and provider approval. A displayed number or route is not guaranteed until provisioned and confirmed.

Customer data and instructions

You retain rights in data and content you provide. You grant Virturing the rights needed to host, transmit, transform, and otherwise process that data solely to provide, secure, support, and comply with obligations relating to the service. You must have authority to supply the data and instructions, including information obtained from callers, recipients, employees, and connected systems.

Calling, consent, and recordings

You are responsible for the legality of call purposes, contact lists, caller identification, scripts, calling windows, suppression lists, opt-outs, recording and transcription notices, AI disclosures, and sector-specific requirements. Do not assume that an available technical feature is lawful for every destination or audience. Honor opt-outs promptly and keep evidence of consent or other authority where required.

AI and human responsibility

AI output can be incomplete, inaccurate, or inappropriate. Configure approved knowledge, scoped tools, test cases, monitoring, fallback, and human escalation that match the risk of the workflow. Do not use Virturing as the sole decision-maker for consequential rights or as a substitute for qualified clinical, legal, financial, or emergency professionals.

Fees, taxes, and payment

Charges may include number leases, carrier legs, minutes, AI runtime, media, storage, recordings, support, and applicable taxes. Rates may differ by destination, provider, model, and approved use. Platform usage records are the basis for billing unless a documented error is established. An order form or dashboard may specify payment timing, credits, deposits, limits, and suspension rights.

Intellectual property

Virturing and its licensors retain rights in the platform, software, APIs, documentation, designs, and service improvements. The customer retains rights in its prompts, business content, integrations, and customer data. Feedback may be used to improve the service without identifying confidential customer information or creating an obligation to implement it.

Confidentiality and privacy

Each party must protect non-public information received from the other and use it only for the relationship, subject to lawful disclosure requirements. Personal data is handled under the Privacy policy, applicable data processing terms, and the customer's configuration. Customers must not place secrets in prompts or logs unless the workflow requires them and appropriate controls are enabled.

Acceptable use and suspension

You must follow the Acceptable use policy and carrier requirements. Virturing may investigate suspicious activity and may limit, quarantine, or suspend affected accounts, numbers, routes, or campaigns when reasonably necessary to prevent harm, comply with law or provider obligations, protect the network, or address material non-payment. Where practical, notice and an opportunity to cure will be provided.

Third-party services

Carriers, model providers, media platforms, payment systems, and customer-selected integrations are separate services. Their availability and terms may affect a workflow. Virturing is responsible for its own obligations, but is not responsible for a third party's independent service, content, or change outside Virturing's reasonable control.

Service changes

Telecommunications and software providers can change availability, quality, pricing, or technical requirements. Virturing may update providers, routes, limits, and features to maintain security, legality, and reliability. Material reductions to a contracted service are handled under the applicable order or written agreement.

Disclaimers and allocation of risk

The public website and non-contracted previews are provided as available and may change. Production commitments, support levels, credits, warranties, liability limits, indemnities, and remedies are those stated in the applicable written agreement. Nothing in these terms excludes rights or liability that cannot lawfully be excluded.

Termination and data export

You may stop using public services at any time. Account termination, number release, outstanding charges, data export, deletion, and transition assistance follow the applicable account settings and contract. Provisions concerning payment, ownership, confidentiality, acceptable use, disputes, and accrued rights survive where their nature requires.

Updates, law, and contact

We may update these terms for legal, security, provider, or service changes. The last-updated date identifies the current version. The governing law and dispute forum are stated in the applicable order or written agreement; mandatory consumer rights remain unaffected.
